Beth Voltz was a featured speaker at the Investors Title Fall Gathering.  In her talk, “Retail Leasing: Strategies for Landlord and Tenant Counsel in the New Leasing Environment,”  Beth covered some of the best strategies for negotiating tricky lease clauses from both the landlord and tenant counsel perspective.  She also provided practical examples of lease clauses that can work in difficult negotiations to the course attendees.

In her role as the 2011-2012 Board President for SAFEchild, Beth Voltz participated in a ride along with the Raleigh Chief of Police, Harry Dolan. After watching the Raleigh SWAT team perform drills simulating forced entry, search and seizure and hostage rescue, Beth spent an evening in the squad car with the Chief.

Will Weatherspoon served as local counsel for New York investors with the purchase of a shopping center in Chapel Hill, North Carolina.

Will Weatherspoon closed the purchase of an apartment project in Fayetteville, North Carolina. While examining title to the subject property, the firm discovered an old access easement running through the center of the development that benefited an adjacent, undeveloped parcel. The transaction was able to close only after the easement was successfully extinguished following months of negotiations with more than a dozen people having an interest in the easement.

November 2011

Beth Voltz negotiated a lease amendment for office and laboratory space in Research Triangle Park, NC for a German company.

Will Weatherspoon represented the purchaser of an apartment complex in Boone, North Carolina, including the assumption of existing financing.

Beth Voltz and Will Weatherspoon were admitted to practice before the U.S. Supreme Court at a swearing-in ceremony in Washington, D.C.

Will Weatherspoon provided local counsel for an out-of-state developer in connection with the purchase of a shopping center in Goldsboro, North Carolina.

Beth Voltz was named the 2011-2012 Board President of SAFEchild in Raleigh. SAFEchild (Stop Abuse For Every child) is a non-profit organization founded in 1992 to prevent child abuse in Wake County by helping adults and children create nurturing environments free from abuse and neglect.

Beth Voltz assisted a Charlotte-based client with the purchase of an office complex in Cary, North Carolina.

June 2011

Beth Voltz handled the acquisition of the Hawk Ridge Apartments in Winston-Salem, N.C. for a New York-based client.  The acquisition included negotiation of the private equity documents for the investors in the project as well as the Freddie Mac financing documents for the acquisition loan.

For the third year in a row, all of the attorneys at Weatherspoon & Voltz LLP participated in the North Carolina Bar Association’s 4ALL Statewide Service Day. Will Weatherspoon and Beth Voltz, along with other volunteer lawyers in seven call centers across the state, answered legal questions for free for N.C. residents who called a toll-free number. The Weatherspoon & Voltz attorneys each worked a three hour shift and answered questions on a wide variety of legal topics.

In her role as Chair of the Law Practice Management Section of the North Carolina Bar Association, Beth Voltz was quoted in an article in NC Lawyers Weekly regarding non-attorney ownership of law firms. See Article...

Beth Voltz closed on a portfolio of loans from Gateway Bank in connection with a client’s debt restructure, and also worked with the client to secure non-traditional financing to complete the acquisition and debt restructure.

February 2011

Beth Voltz closed a $17,700,000.00 permanent loan on an apartment project in Fayetteville, N.C. Beth and Rob also closed on a separate loan for construction of a second phase of the same complex in February.

Will Weatherspoon assisted clients with the purchase and financing of older apartment complexes in Chapel Hill and Raleigh, North Carolina, both of which are well-positioned for redevelopment in the near future.

Beth Voltz closed on the purchase of five (5) acres in Fayetteville, N.C. that will be used as the second phase of a luxury apartment complex.

Beth Voltz represented the buyer in the acquisition and construction of the initial phase of the apartment complex in April 2009.

Beth Voltz handled a construction loan for a client who is building a 7,500 square foot custom building for a retail tenant. Beth Voltz also handled the lease negotiations with the tenant who will occupy the building.

Beth Voltz assisted a landlord with the execution of two new leases for a redeveloped shopping center in Raleigh. One of the leases (7,400 square feet) is for an outpatient dialysis facility. The other lease (14,000 square feet) is for a specialty pet supply store.

Beth Voltz handled the sale of a 24,976 square foot office condominium in Research Triangle Park for the seller of the condominium unit. The sale included the negotiation of an amendment to the condominium declaration to allow for the buyer’s intended use of the condominium unit after closing.

July 2010

Beth Voltz represented a tenant in connection with the lease of 25,000 square feet in a shopping center in Durham, North Carolina for use as a grocery store.

Will Weatherspoon assisted a client with the acquisition and financing of an office building on Fayetteville Street in downtown Raleigh.

Beth Voltz assisted a client with the sale of a medical office building in Raleigh. The sale negotiations included the execution of a new lease with Rex Physicians for space in the medical office building.

Will Weatherspoon assisted a client in the closing of a $19,385,000 construction loan for the development of a 196-unit apartment complex located in Cary, North Carolina. The loan is being insured through the HUD Section 221(d)(4) program.

Beth Voltz and Michelle Rich Goode of Rich Commercial Realty/Keller Williams Commercial presented a commercial bankruptcy seminar entitled “Commercial Bankruptcy: What to do when Landlords and Tenants are feeling distressed.”  Beth Voltz served as moderator for the panel discussion.  The participants on the panel were Will Weatherspoon, Lee Hogewood of K&L Gates, Tom Fritsch of Highwoods Properties, and Neal Anderson of Anderson Bauman Tourtellot Vos. More than fifty (50) commercial brokers attended the seminar, which was held at the Keller Williams Commercial office.
